Privacy policy

Purpose of this policy


Electricity Supply Industry Superannuation (Qld) Ltd (the "Trustee") and its subsidiary ESI Financial Services Pty Ltd are bound by the National Privacy Principles under the Privacy Act 1988. The National Privacy Principles are a set of rules organisations must comply with in managing personal information about individuals.


The Trustee and its subsidiary are committed to protecting your privacy. Part A of this document sets out Electricity Supply Industry Superannuation (Qld) Ltd's (as Trustee for Energy Super) policy on the management of personal information about Energy Super members. Part B of this document sets out these details for clients of ESI Financial Services Pty Ltd. A copy of this document is available to any person who asks for it.


PART A : The Privacy Policy applying to Energy Super

1. Personal information that we hold and why we collect it

When a member joins the Fund, Energy Super asks for the following information:

  • identification details, which are normally the member's name and address, tax file number;
  • gender, date of birth and contact numbers; and
  • if joining the Defined Benefit category, information about the member's state of health and medical history.


Identification details are needed to process each member's application, administer their funds and work out their benefits. Information about the member's state of health and medical history may be needed so that the member's eligibility for death and disablement benefits can be assessed.


All information that Energy Super collects is provided to IFAA, a service provider of Energy Super . IFAA employs staff members who provide administrative and other services to Energy Super members. Information is also provided to ESI Financial Services Pty Ltd, a wholly owned subsidiary of Electricity Supply Industry Superannuation (QLD) Ltd, for the purposes of answering calls, financial planning services and general administration.

Energy Super will hold the details of each member's account balances, investments, contributions and benefits during the course of each member's membership, and for Defined Benefit members will hold details of their salary.

When a benefit is due to be paid, Energy Super may ask for bank account details for payment of the benefit, and may also ask details of the member's future employment intentions to confirm whether the benefit can be paid in cash.


If a member dies, Energy Super needs information about persons who are entitled to be considered for distribution of the member's death benefit. This includes the member's spouse, children, any other dependant, and any person who might be a beneficiary of the member's estate.


The information Energy Super may ask for about those persons will be their name, address, gender, date of birth, details of their financial position and financial needs, and any other information that will assist Energy Super in deciding whom the death benefit should be distributed to.


2. How we collect, use and disclose personal information

Energy Super collects information about members through Application Forms completed by new employees, and through various other forms completed by members to update their details.
Some information about members is collected from employers:

  • when a member joins the Fund, the employer may provide the member's name, address, tax file number, and salary details, and the employer will normally provide the date of commencement of employment;
  • for Defined Benefit members, the employer provides details of the member's salary each year;
  • when a benefit is payable, the employer provides details of the date of termination of employment and contributions; and employers may also notify Energy Super of updated address details from time to time.


On a member's death, Energy Super will normally collect information about potential beneficiaries from the beneficiaries themselves. However, Energy Super will also collect some information about the identity of potential beneficiaries from the member's executor or administrator or whoever notifies Energy Super of the member's death.


If a member makes a claim for a disability benefit, more information is collected about the member's disability in order to assess the member's eligibility for the benefit. Most of this information is collected from the member, but information is also collected from the member's employer, doctors and other experts.


Energy Super discloses personal information about members to parties that are contracted to manage the business such as IFAA or Energy Super's related company, ESI Financial Services Pty Ltd. ESI Financial Services Pty Ltd employs financial planners to provide services to Fund members. ESI Financial Services Pty Ltd sometimes assesses information about the benefit entitlements of terminating members to identify those who could benefit from the services of a Financial Planner. IFAA and ESI Financial Services Pty Ltd provide services to Energy Super under a contract which contains privacy provisions.


Energy Super does not normally disclose personal information about members to any other external parties without the member's written authorisation, except where required by law (for example, Energy Super may be obliged to disclose information about members to the Australian Taxation Office, Centrelink or AUSTRAC).


However, Energy Super provides services to members through arrangements with a number of external parties (such as insurers, employers, actuaries and research consultants). Energy Super may disclose personal information about members to such organisations in the course of providing member services and administering benefits.


Where a member makes a claim for a disability benefit the claim will be passed on to the insurer, information might then be disclosed to doctors and other experts nominated by Energy Super or the insurer. Energy Super may notify the member's employer that a claim has been made in order to ask the employer for information to assist in assessing the claim. In addition, if there is any dispute about a member's entitlement, Energy Super may disclose information about the member to other advisers (for example, legal advisers).
Energy Super does not disclose information about members to other organisations for marketing purposes.

3. Member access to information

Members are entitled to access information Energy Super and IFAA and ESI Financial Services hold about them. If a member wants to check that their personal details are correct or find out information about their benefit, they can contact Energy Super by telephone or in writing.


Requests for information can sometimes be answered over the telephone, or a copy of the information can be sent by post. To correct member details, written confirmation may be required but some changes (such as a change of address) can be made by telephone.


For security reasons, Energy Super will not give any information over the telephone unless the person making the enquiry is able to answer some questions designed to confirm their identity. Written requests for information must be signed by the member.


Members can also make arrangements, by telephone or in writing, to come in to Energy Super's office at an appointed time during normal working hours to look at their information on their file. Again, proof of identity will be required.
Members cannot access information about any other member, including their spouses, without the other member providing consent.


4. Keeping information up-to-date

Energy Super tries to ensure that the information it holds about members remains accurate, complete and up to date. At the time of joining, members are sent a "welcome letter" asking them to check and correct their details. When members are sent their annual Member Statements, they are asked to notify any changes in their personal information.


5. Complaints

If any member has a complaint about a possible breach of their privacy, the member should first contact the CEO and/or Fund Secretary of the Fund. Energy Super's Complaints Procedure is set out in the Member Booklet.


If the complaint is not resolved, members can complain to the Office of the Federal Privacy Commissioner, telephone 1300 363 992.

PART B : The Privacy Policy for ESI Financial Services

ESI Financial Services Pty Ltd (ESI FS) as a subsidiary of Electricity Supply Industry Superannuation (Qld) Ltd (Trustee for Energy Super) is bound by the National Privacy Principles under the Privacy Act 1988. The National Privacy Principles are a set of rules organisations must comply with in managing personal information about individuals.


ESI FS is committed to protecting your privacy. This document sets out ESI FS's policy on the management of personal information about ESIFS clients (which can include Energy Super members). A copy of this document is available to any person who asks for it.


1. Personal information that we hold and why we collect it

 
This policy covers the collection and storage of personal information by ESI FS including the following circumstances:

  • When an Energy Super member accesses phone helpline, financial advisory or education seminars provided by ESI FS on behalf of Energy Super; and
  • Where an individual who is not an Energy Super member accesses, phone helpline, financial advisory services or education seminars provided by ESI FS.

In regards to Energy Super members, the Energy Super Privacy Policy allows Energy Super to provide ESI FS with any information it holds about members to enable ESI FS to understand the benefit entitlements of Energy Super members who access the services described above or for whom Energy Super wish to keep informed of the services available to them as a member of Energy Super. These details include:

  • identification details, which are normally the member's name and address, tax file number; and
  • gender, date of birth and contact numbers;
  • benefit entitlements within Energy Super; and
  • if a member of the Defined Benefit category, information about the member's state of health and medical history.


For Energy Super members and private clients of ESI FS who require financial advisory services ESI FS collects and utilises information required by ESI FS to meet its Australian Financial Services Licence obligations when providing financial product advice to you. In broad terms this is referred to as the "know your client" rule and refers to the information a financial adviser would reasonably need to know about you in order to provide the advice that you require and so that advice is appropriate to your needs and circumstances. This information may also include details required to assist you to implement the advice - such as bank details, Tax File Number and information to verify your identity.


2. How we collect, use and disclose personal information


This personal information is usually collected from by completing a document referred to as "Financial Planning Questionnaire" or other written data collection forms. Information provided by you by phone may also be recorded for record keeping purposes. If you do not wish such calls to be recorded you should request this of the person taking or making the call.


Information ESI FS holds about clients is not normally disclosed to any external parties. However, ESI FS provides services to clients through contracted arrangements with a number of external parties (such as paraplanning service providers, insurers, investment managers and investment platform providers). ESI FS may disclose personal information about clients to such organisations in the course of providing the advisory services you require. Any such contracted organisation would provide services to ESI FS under a contract which contains privacy provisions.


ESI FS does not normally disclose personal information about clients to any other external party without the client's written authorisation, except where required by law (for example, ESI FS may be obliged to disclose information about clients to the Australian Taxation Office, Centrelink or AUSTRAC).
